The applicants are seeking pre-arrest bail in Crime No. I-116 of 2016 registered with Shevaon Police Station, District Ahmednagar, for the offence punishable under Sections 306, 498-A, 506 read with Section 34 of the Indian Penal Code.

The story of the prosecution is that the complainant's daughter Pushpa was married to son of applicant Gajabai and brother of Rahul namely Shankar about five years back. Pushpa committed suicide on 23rd April, 2016, resulting into lodging of the first information report.

The other co-accused Shankar, husband of deceased Pushpa is already released on bail, whereas her father in law is ordered to released on pre-arrest bail by learned Sessions Judge.

In view of above, in my opinion, once husband had already undergone custodial interrogation and the fact that father in law of the deceased Pushpa is ordered to be released on bail by learned Court below, the applicant deserves to be released on bail. Hence, the following order :- (a) In the event of arrest, the applicants be released on bail, in connection with Crime No. I-
(3) 116 of 2016 registered with Shevaon Police Station, District Ahmednagar, for the offence punishable under Sections 306, 498-A, 506 read with Section 34 of the Indian Penal Code, upon furnishing P.R. bond of Rs.15,000/- with one surety in the like amount, by each of them.
(b) The applicants shall attend the concerned police station on 9th and 10th August, 2016 between 10-00 a.m. to 12-00 noon and thereafter as and when called.
