The applicants are seeking pre-arrest bail in Crime no. 82 of 2016 registered at Patoda Police Station, Dist. Beed for the offences punishable under section 147, 148, 149, 307, 323, 504, 506 of the Indian Penal Code.

Learned A.P.P. opposed the application on the ground that there are eye witnesses to the incident and the offence under section 307 of the Indian Penal Code, is punishable with life.

Upon perusal of the investigation papers, it is noted that the complainant has suffered two simple injuries, of which, one is caused by sharp weapon, whereas another by blunt object. In view of the injuries suffered, the role attributed to the accused / applicant no.1 - Narayan Amte appears to be improbable.

Apart from above, there is a doubt created, in view of the registration of another crime at the best of applicants, being crime no.81 of 2016 punishable under section 143, 147, 148, 149, 307, 323, 504, 506 of the Indian Penal Code, as pointed out by learned counsel for the applicants. In view thereof, the following order:- 6.
In the event of the arrest of the
3 Cri. Appln. 3057-2016 applicants in Crime no.82 of 2016 registered with Patoda Police Station, Dist. Beed for the offences punishable under section 147, 148, 149, 307, 323, 504, 506 of the Indian Penal Code, they be released on bail upon their executing P.R. bonds in the sum of Rs.15,000/- (Rs. Fifteen Thousand) each with one surety each in the like amount.

The applicants shall attend the concerned Police Station on 1st July, 2016 and 2nd July, 2016 between 10 am and 12 noon and, thereafter, as and when called by the Investigating Officer.

The applicants shall not tamper with the prosecution evidence or prosecution witnesses. 9.
Criminal Application stands disposed of accordingly.
