This is an application by the State seeking deletion of name of respondent No.2, incorporated in the contempt petition presented by the petitioner/ respondent in the application.

It is pointed out that the Chief Secretary of the Maharashtra State was not party to the main proceeding and as such, no direction was issued to the Chief Secretary. In fact, the grievance of the petitioner is against the Education Department which shall have to look into by the said department. 3.
Considering the contentions raised, the application deserves to be allowed and the same is accordingly allowed.

Name of respondent No.2, the Chief Secretary stands deleted from the array of respondents in the contempt petition and instead, it would be permissible for the petitioner to implead the Principal Secretary, School Education & Sports Department, Mantralaya, Mumbai as party respondent. Necessary amendment be carried out in the contempt petition within a period of three weeks from today.
5. Civil Application stands disposed of.
