THE EX. ENGINEER, AND LIFT IRRIGATION DEPARTMENT AND OTHERS ...

Advocate for Applicants : Mr. Jadhavar S.G.

AGP for Respondents - State : Mr. P. M. Kulkarni Advocate for Respondent No.1 : Mr. H. P. Kshirsagar ...

CORAM : S. G. DIGE, J.

DATE : 12.07.2022 PER COURT :

.

Heard learned counsel for applicant, learned AGP for respondent Nos. 2 and 3 and learned counsel for respondent No.1.

2.

Learned counsel for the applicant submits that respondent No.1 has challenged the order of Reference Court, by way of appeal. This Court had directed respondent No.1 to deposit the entire award amount before this Court. Accordingly, respondent No.1 had deposited the entire award amount, but inadvertently respondent No.1 has deposited the award amount in First Appeal No. 1484/2021. However, there

are two appeals namely First Appeal No. 1484/2021 and First Appeal No. 1483/2021. Respondent No.1 has deposited the award amount of First Appeal No. 1484/2021 into First Appeal No. 1483/2021 and the award amount of F.A. No. 1483/2021 is deposited into First Appeal No. 1484/2021. Therefore, it is necessary to make correction in that regard by transferring the amount of both the appeals in respective appeals. 3.

Learned counsel for respondent No.1 admitted that inadvertently the award amount of both the appeals are deposited.

4.

Considering the submissions of both the counsel, the award amount of each appeal be corrected accordingly and be deposited in respective appeals.

5.

Application is disposed of.
