st July, 2015 DATED : 1 PER COURT :- 1] This is an application under Section 407 of the Code of Criminal Procedure for transfer of Sessions Trial No.128 of 2014 pending on the file of the learned Additional Sessions Judge, Aurangabad to any other Sessions Division than Aurangabad and Ahmednagar.

2] Learned counsel for the applicants who are accused in the Sessions Trial submit that the victim, all the witnesses and advocates are from the same place, and therefore, the applicants will not get fair trial and as such they have certain apprehension in their mind. Merely on the basis of apprehension, which nurses in the mind of accused persons, the Sessions Trial cannot be transferred.

3] Hence, application is dismissed.
