Petitioners are before us being aggrieved and dissatisfied by the decision dated 11.01.2024 of the respondent No. 03/Deputy Director of Education refusing to include their names in the Shalarth Pranali on the ground that they have not cleared TET. 3.

We have consistently taken a view in the light of the issue regarding not clearing TET has been pending before the Supreme

2 wp 5895.24 Court and directing the authorities to consider the proposals for including the names in the Shalarth Pranali making it subject to final outcome of the matter before the Supreme Court. One such order has been annexed with these petitions passed in the matter of Dattatraya Devidas Sonwale and another Vs. The State of Maharashtra in Writ Petition No. 1111 of 2023 dated 07 September 2023 and Ankush Kautik Gonge Vs. The State of Maharashtra and others in Writ Petition No. 9944 of 2023 dated 10 August 2023.

Considering the fact that it was a joint proposal of six Assistant Teachers including present two petitioners and the Deputy Director of Education by the impugned communication/decision had directed names of other four Assistant Teachers to be included in the Shalarth Pranali subject to certain conditions while rejecting the proposals of present petitioners, it would be appropriate that even a direction is given to include names of the petitioners in the Shalarth Pranali, subject to the final outcome of the matter before the Supreme Court and subject to all the conditions and directions imposed and given by the Divisional Deputy Director of Education in the impugned communication dated 11.01.2024.

We direct Deputy Director of Education accordingly to pass appropriate order within four (04) weeks.
