The Petitioners have raised a grievance that despite report submitted by the Chief Executive Officer of the Zilla Parishad as far back on 18.12.2024, the Respondent No.2-Commissioner has not taken any decision on the same, although proviso to Section 39(1) stipulates that the Commissioner is required to take a decision within one month from the date of receipt of report of the Chief Executive Officer. 2.

The Writ Petition itself can be disposed of by issuing directions in the facts and circumstances of the present case.

Accordingly, the Respondent No.2-Commissioner is directed to take a decision on the report dated 18.12.2024 submitted by the Respondent No.3-Chief Executive Officer, Zilla Parishad after giving a reasonable opportunity of hearing to all the concerned. The decision shall be taken within four weeks from today.
