The applicant, by this application, prays for condonation of 61 days delay caused in filing this civil application and further prays for recalling of the order of this Court dated 24/03/2015, by which the petition was dismissed.

Reasons in support of the prayers are set out in the civil application. Learned Advocate for respondent No.1 and the nonapplicant No.1 herein submits that the reasons cited are not satisfactory. The application deserves to be rejected. In the event, the application is to be allowed, costs be imposed on the applicant. khs/July 2015/7085-15 (d)

In the light of the above, and for the reasons set out in the application, the same is allowed. Delay of 61 days is condoned by imposing costs of Rs.1,000/- (Rs.One thousand only), to be deposited in this Court within 4 (four) weeks from today. After the costs is deposited, the order dated 24/03/2015 shall stand recalled and the petition shall stand restored.

The applicant shall furnish the detailed address of respondent No.2 after the petition is restored. After the above stated order is complied with, notice be issued to respondent No.2, returnable on 21/08/2015.
