Janhavi Santosh Mupade v. The State Of Maharashtra Through Its Secretary And Another
7101.22wp (1)
IN THE HIGH COURT OF JUDICATURE AT BOMBAY
BENCH AT AURANGABAD 941 WRIT PETITION NO.7101 OF 2022 JANHAVI SANTOSH MUPADE
VERSUS
THE STATE OF MAHARASHTRA THROUGH ITS SECRETARY AND ANOTHER ....
Mr G. K. Chinchole, Advocate h/f Mr S. M. Vibhute, Advocate for petitioner;
Mr A. R. Kale, A.G.P. for respondents/State CORAM : RAVINDRA V. GHUGE AND ANIL L. PANSARE, JJ.
DATE : 12th July, 2022 PER COURT:
1.
The petitioner has tendered her validation claim of belonging to 'Mannervarlu' Scheduled Tribe, on 08/02/2022. She prays that a direction be issued for an early decision in the pending proceedings, as she intends to apply for the professional courses.
2.
The learned A.G.P. appearing on behalf of the respondents submits that the Committee is granting a higher priority to the matters involving students. But in such cases, as the petitioners are belatedly approaching the Committee and then moving a
7101.22wp (2) petition for seeking early decision, creates a cumbersome situation for the Committee and there is a possibility that the Committee might commit mistakes while racing against time, only to meet the deadline ordered by the High Court. He, therefore, prays for time till February 2023.
3.
Having considered the situation, we find that the Committee should make an endeavour to decide the claim of the petitioner by 30/11/2022.
4.
In view of the above, this petition is disposed off, with a direction to the Committee, to decide the claim of the petitioner by 30/11/2022. The petitioner shall wholeheartedly co-operate for an early decision within time frame.
