This is a pre arrest bail application apprehending arrest in crime no. 0360 of 2024 registered at Virgaon Police Station, District Chhatrapati Sambhajinagar for offences under Sections 109, 125(a), 119(1), 125, 189(2), 191(2), 190, 352, 351(2), 351(3) of BNS. 2.
Learned counsel for the applicant submits that, there is false implication. That, there are allegations of hitting by means of sling shot. That, all injuries are in the nature of abrasions and there are no major injuries. That, except such allegations and general allegations of threat to kill, there are no other major allegations. That, applicants are ready to co-operate in the investigation. That, nothing is to be recovered at their instance, and for all above reasons, learned counsel
-2urges for grant of anticipatory bail.

Learned APP strongly opposed on the ground that, there are allegations of causing injury. Learned APP pointed out that, both applicants are involved in theft of sand and are part of sand mafia. That, against applicant Sachin and co-accused Sandip, there are previous crimes and as such, they have criminal antecedents. That, they are indulging in such activities like causing injuries to people who take objection for sand theft. That apart, there are allegations of threats to kill and also allegations against Sandip for snatching two mobiles and cash Rs.25,000/-. Thus, for effective investigation, learned APP has opposed the application.

Heard. Perused the FIR dated 12.11.2024 at the instance of one Ganesh Ugale. Substance of the FIR is that, on 12.11.2024, while he and his uncle Govind were proceeding on motorcycle, they came across Sandip, Sachin (present applicant no.2), Sadik, Nilesh and Pappu (present applicant no.1). It is further alleged that, these persons told informant that they have to transport sand from that area and to not to cultivate fields there. It is further alleged that these persons made use of sling shot for hitting stones in the direction of informant and his uncle, causing injuries on chest, abdomen and
-3limbs. There are also allegations that after abuse, Sandip took away informant's OnePlus make mobile and his uncle's Realme company mobile as well as cash Rs.25,000/-.

Learned APP has made a statement across the bar, and has placed police papers on record regarding antecedents of applicant Sachin. On going through the same, it is emerging that, there is previous crime for commission of offence under Section 307 of IPC to his credit, i.e. applicant namely Sachin. Papers also show that above occurrence was video-graphed and further forwarded on social media. Considering the statement made across the bar by learned APP that both present applicants are part of sand mafia, and also taking into consideration the allegations in the FIR wherein informant has been threatened to not to cultivate the land as accused persons intend to transport sand, this Court is not inclined to extend the benefit of anticipatory bail. In view of above material, investigation needs to be taken to its logical end. Hence, following order :
ORDER
The application is rejected.
