After a lengthy hearing in this matter on 04.09.2024, 05.09.2024 and today, the issue has narrowed down to what was expected by the Petitioner from the Zilla Parishad. The Desk Officer of the Rural Development Department, Maharashtra Government, Mumbai, had addressed a letter dated 03.06.2024, to the Chief Executive Officer, Zilla Parishad, Parbhani, vide which, a proposal with regard to the grievance of the Petitioner, was to be tendered. The copy of the said letter placed before us is marked as "X-1" for identification.

The learned Advocate for the Zilla Parishad submits on instructions that yesterday, the Chief Executive Officer has forwarded a proposal dated 05.09.2024, directly to Respondent No.2. 3.

In view of the above, this Writ Petition is disposed off. Respondent No.2 shall decide the proposal, within sixty days from today, by following the due procedure and by referring to the record with regard to the Petitioner's service. A reasoned order be passed and the same be communicated to the Petitioner within fifteen days of the declaration of the decision.

Needless to state, if the model code of conduct is introduced, the same would not be an impediment for deciding the said proposal within sixty days.

Pending Civil Application No.5557 of 2024. is disposed off.
