Heard the learned Advocate for the Applicant and the learned APP for the Respondent - State. Perused the papers on record. 2.

The Applicant is apprehending arrest in Crime No.0105/2025, registered with Begumpura Police Station, District Chhatrapati Sambhajinagar, for the offence punishable under Sections 64(2)(m), 69, 115(2), 352 and Section 351(2) of the Bharatiya Nyaya Sanhita, 2023, and therefore, he has filed this Application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for Anticipatory Bail.

The aforesaid Crime is registered on the report lodged by the Prosecutrix. She is a married woman having one daughter and is residing separately from her husband. She came in contact with the Applicant in the year - 2022 and friendship developed between them. According to the Prosecutrix, on 26/11/2022, the Applicant established physical relation with her by giving a promise of marriage. Thereafter, from time to time, the Applicant established physical relation with the Prosecutrix. As a result of the physical relations, the Prosecutrix became pregnant. The Applicant insisted for the abortion and beaten the Prosecutrix and refused to marry her. Thus, she lodged the report.

Undisputedly, the Prosecutrix was major when she came in contact with the Applicant and when the physical relations were established by the Applicant with her. The FIR shows that, the Prosecutrix was living separately from her husband. There is nothing to show that, there was divorce between the Prosecutrix and her husband. Therefore, the version of a false promise of marriage by the Applicant, who was nineteen [19] years of age at the relevant time, may be the outcome of exaggeration. Prima facie, the relation appears to be consensual. The learned Advocate for the Applicant submits that, the Applicant is ready to join the investigation and also ready to give samples for chemical analysis. Considering the aspects of the matter, I am inclined to allow the Application. Hence, the following order :

ORDER

[I] Anticipatory Bail Application is hereby allowed. [II] In the event of arrest of the Applicant, namely, Ritesh S/o Mukesh Lahot, in connection with Crime No.0105/2025, registered with Begumpura Police Station, District Chhatrapati Sambhajinagar, for the offence punishable under Sections 64(2)(m), 69, 115(2), 352 and Section 351(2) of the Bharatiya Nyaya Sanhita, 2023, he be released on bail on his furnishing P.B. of Rs.15,000/- [Rupees Fifteen Thousand] with one surety in the like amount, on the following conditions:

[a] The Applicant shall co-operate with the Investigating Machinery.

[b] The Applicant shall attend the concerned Police Station on last Thursday of every month between 12:00 p.m. to 02:00 p.m., till the charge-sheet is filed.
