IN THE HIGH COURT OF JUDICATURE AT BOMBAY BENCH

AT AURANGABAD 21 CRIMINAL APPLICATION NO. 2381 OF 2024 IN BA/628/2024 NARAYAN TUKARAM IRABATANWAD

VERSUS

THE STATE OF MAHARASHTRA ...

Advocate for Applicant : Mr. More P. P.

APP for Respondent-State : Mr. S. B. Narwade. ...

CORAM :

S. G. MEHARE, J.

DATE :

18.06.2024 PER COURT :- 1.

Heard the learned counsel for the applicant and learned APP for the respondent-State.

2.

The applicant was granted temporary bail by the order of this Court dated 17.04.2024. The request of the applicant for medical treatment was considered and two months temporary bail was granted to the applicant. He went to the Mangeshkar Hospital at Pune. He has undergone the treatment. Papers placed on record shows that he was advised for rest for one month and come for followup. However, the applicant has filed the prescription of Dr. Khadkekar of Shri. Chidrawar Super Speciality Hospital. He did not produce a certificate of

Medical Practitioner specifically mentioning that he further requires further indoor treatment. As per the order, he was to surrender today. But as per the routine practice, the application for extension of time was filed on 14.06.2024, which was the last working day of that week and urgent circulation was sought for today, which is a date for surrender. This is very regular practice experienced here to secure the reliefs. Be that as it may, the applicant has no certificate of the Medical Officer advising him further treatment by private hospital at his own expenses. A request of the applicant does not inspire confidence. He appears to have played some foul game to stay away from the jail.

3.

For the above reasons, the criminal application stands dismissed.
