The petition is opposing the probable grant of FL3 licence in favour of Respondent No.5, on Plot No.70, CTS No. 6008/A. The learned Government Pleader submits that in such matters this Court need not issue a writ of mandamus. There is a committee under section 44-A of the Maharashtra Prohibition Act, 1949 which would consider the application for licence in the light of section 45 of the Act. 2.

In view of the above, this petition is disposed off with the expectation that the Committee would decide the pending application of Respondent No.5 with regard to grant of FL3 licence and consider whether there is any objection or opposition by the residents of the Colony, in accordance with the rules and policies applicable.
