(2) Cri. Appln. No. 3068 of 2016 particularly, the statement of the prosecutrix recorded under Section 164 of the Code of Criminal Procedure, 1973.

Prima facie it appears that the offence is made out. In view of this, the application seeking relief under Section 439 of the Code of Criminal Procedure, 1973, deserves to be rejected. The same is rejected accordingly.

The learned Sessions Judge, seized with the matter, shall make an endeavour to conclude recording of substantive evidence within one year from the date of framing of charge.

With the above observations, the Application stands dismissed.
