This matter is heard for some time.

Learned Advocate for the petitioners submits that their representations dated 15/05/2012, 08/05/2012 and similar other representations are pending before respondent No.1, which has granted permission to respondent No.4 to start a new Arts College at Betawad, Tal.Sindkhed, Dist.Dhule. It is submitted that the said representations can be decided by respondent No.1 on their own merits.

He further submits that considering the passage of time, the khs/NOV. 2017/6099
petitioners would tender a fresh representation to respondent No.1 within 6 weeks from today and the same can be decided expeditiously.

Considering the above, this petition is disposed of with liberty to the petitioners to file a representation within 6 weeks to respondent No.1. After receiving such representation, respondent No.1 shall conduct a hearing so as to ensure that the parties, who are likely to be affected by any order passed on the representation, are given a due opportunity of hearing. After considering the contentions of all the sides, the said representation shall be decided within a period of 6 months from the date of receiving the same. 5.
Needless to state, we have not expressed any opinion on the merits of the matter and we leave it to respondent No.1 to decide the representation on its own merits.
