PER COURT :- The affidavit in reply filed by the respondents indicates that the order has been complied with. The petitioners were not entitled to D.Ed. scale and therefore, not been granted that scale. The order of which the contempt is alleged was in the nature of directing to accord to the petitioners the scale as 'deemed trained teacher'. It has also been averred in the affidavit in reply that the petitioners have been granted the pay scale of deemed trained teachers. The pay has been fixed and pension has also been paid to the petitioners. 2.

In view of the above, we dispose of the contempt petition with a rider if the petitioner comes complaining the order to have not been complied with in toto, the contempt petition would be revived. (SANJAY A. DESHMUKH, J.) (R. G. AVACHAT, J.) rlj/
