Mr. M. B. Pophale, Advocate holding for Mr. P. A. Kulkarni, Advocate for Respondent.

CORAM : R. M. JOSHI, J.

DATE : 11th NOVEMBER, 2024.

PER COURT :

1.

This is an application for transfer of marriage Petition bearing HMP No. 507/2024 pending before the Family Court, Nagpur to the Family Court, Chhatrapati Sambhajinagar. 2.

Applicant is wife and seeks transfer on the ground that it is inconvenient for her to travel more than 450 kms from Chhatrapati Sambhajinagar to Nagpur to attend the said proceeding. 3.

Learned counsel for Applicant submits that the Applicant is working at Chhatrapati Sambhajinagar and that prejudice and

4.

Learned counsel for Respondent vehemently opposed the application by contending that except for the alleged distance between two places, there is no reason given for transfer of the said proceeding.

5.

Here is the case if husband is called upon to come to Chhatrapati Sambhajinagar for attending said proceeding, less inconvenience will be caused to him as compared to the applicant. This would be sufficient ground to allow transfer application. Hence, application stands allowed in terms of prayer clause 'B'. ( R. M. JOSHI) Judge dyb
