Heard the learned counsel for the applicant and learned APP for the respondent-State.

The applicant has been arraigned as an accused with the allegations that he has illicit relations with the wife of the deceased. Except this, there is nothing against the applicant. 3.

Learned APP has opposed the application contending that the custodial interrogation of the applicant is required to know how the applicant was maintaining extra marital relation with the wife of the deceased.

Perused the papers. It appears that the deceased committed suicide out of the frustration that his wife has extra marital relation with the applicant. Except this there are no

2 917-ABA.829-22.odt allegations against the applicant. The record does not reveal that the custodial interrogation of the applicant is essential. Hence, the application deserves to be allowed. Hence, the following order :

O R D E R

(i) The application is allowed.

(ii) The interim protection granted to the applicant VIVEK @ VIVEKANAND TULSIDAS DESHMUKH by an order dated 07.07.2022 stands confirmed on the same terms and conditions.
