We have heard the learned counsel for the petitioner for some time.

The learned counsel for the petitioner, on instructions, seeks leave to withdraw this Petition with liberty to the petitioner to avail of the remedy of filing an application under section 190, subsection (1), after clause (c) provisos as per State Amendment (Maharashtra) of the Code of Criminal Procedure, seeking sanction from the State Government to prosecute the accused person, who happens to be a Naib Tahsildar.

Leave granted. The Petition is dismissed as withdrawn with liberty to the petitioner as aforesaid.
