We have heard Mr. Patil, the learned counsel for the petitioner. The learned counsel relies on the judgment of the Apex Court in a case of Nawal Kishore Sharma V/s Union of India and Others reported in 2014 (9) SCC 329. 2.

It would not be appropriate to appreciate the arguments of Mr. Patil, the learned counsel in view of the withdrawal of the Original Application by the petitioner himself. The order of the Tribunal reads as under -

Learned counsel for the applicant, on instructions, seeks leave to withdraw the present OA with liberty to file fresh OA before the appropriate forum.

In view of the said submission present OA stands disposed of, as withdrawn, with liberty as prayed for."

If the petitioner feels that, the Tribunal at Aurangabad had the jurisdiction the petitioner is at liberty to seek appropriate orders from Tribunal at Aurangabad after filing appropriate application with regard to the order dated 09.06.2015 passed by the Tribunal in Original Application No. 536 of 2015.
