Heard learned counsel for the respective parties. 2.

By way of present petition, the petitioner is challenging the order dated 28.04.2022 passed by respondent no.2, the Chief Controlling Revenue Authority and Inspector General of Stamps, Maharashtra State, Pune in Appeal No.24 of 2020 whereby the appeal filed by petitioner society came to be dismissed. 3.

Learned AGP submits that the document was already executed and now, the petitioner has made specific prayer for claiming refund in the present writ petition. 4.

I have gone through the appeal which was filed by the petitioner before respondent no.2. I find that there was no pleading and prayer for claiming of refund.

Therefore, without going into the merits of the matter, I am inclined to dispose of the petition with liberty to the petitioner to file appropriate application before the competent authority for claiming refund.

If such application is filed, the authority to consider the same independently on its own merit without being influenced by the earlier order passed by respondent no.2.

Writ Petition stands disposed of.
