The applicant is seeking his release on regular bail on parity with that of co-accused Sandeep Ashok Pawar, who was released by this Court, vide order dated 9th June, 2016, passed in Criminal Application No. 2655 of 2016, in connection with Crime No. I-345 of 2015, registered with Shrirampur City Police Station, Tq. Shrirampur, District Ahmednagar, for offences punishable under Sections 326, 365, 367, 323, 504, 506 read with Section 34 of the Indian Penal Code.

It is brought to my notice that victim Subhash Dashrath Labade has suffered grievous injuries.

The investigation in the matter is complete and charge-sheet is filed. 4.
Perused the order passed in the matter of co-accused Saneep
criap3079.16 (2) Ashok Pawar, cited supra, and the investigation carried out in the present matter. Fact remains that the present applicant, who is seeking bail on parity basis, though was identified in the identification parade in the crime in question, he was already ordered to be released on bail in the offence punishable under Section 302 of the Indian Penal Code, by the learned Additional Sessions Judge, Shrirampur. Apart from above, fact remains that once chargesheet is filed, in my opinion, further detention of the applicant is not necessary.

In the above background, in my opinion, the applicant is entitled to be released on bail. Hence I pass following order: (a) The applicant be released on bail, in connection with Crime No. I-345 of 2015, registered with Shrirampur City Police Station, Tq. Shrirampur, District Ahmednagar, for offences punishable under Sections 326, 365, 367, 323, 504, 506 read with Section 34 of the Indian Penal Code, on furnishing P.R. Bond of Rs 25,000/- with one surety in the like amount.
(b) The applicant shall not enter the jurisdiction of the concerned police station till conclusion of the trial, but for attending the Court proceedings. Criminal Application stands allowed in above terms. (N.W. SAMBRE, J.) sjk
