Admittedly, the petitioner has no property within the limits of the Municipal Council, Kinwat. In that view of the matter, the petition at the instance of the petitioner is not maintainable. The wife of the petitioner has filed an application for substituting herself in place of the petitioner. Said prayer cannot be considered. However, wife of the petitioner, if so desires, can file separate petition.

With the above observations, petition stands disposed of. Consequently, civil application does not survive and stands disposed of.
