Heard learned counsel for the applicant and learned APP for the State.

The applicant seeks bail in Crime No.464 of 2023 registered with Jamkhed Police Station, District Ahmednagar for the offence punishable under Sections 302, 498-A, 323, 504, 506 r/w 34 of the Indian Penal Code.

The daughter of the applicant and deceased is the witness to the incident. Before the assault to the deceased with wooden log, the deceased and the applicant had quarrel. The deceased took away Rs. 400 from his pocket and then she went to the house. Thereafter, the brother of the applicant followed her and assaulted her with wooden log on her head and she died. Considering these two incidents, the applicant appears to have not participated in the actual incident of assaulting the deceased with wooden log. There is no role

961-ba-987-2024.odt (2) attributed to the applicant in committing the murder of the deceased. Nothing is to be recovered from him. Hence, he deserves bail. Hence, the following order :

O R D E R

(i) Bail Application is allowed.

(ii) Applicant, Balu Arun Ghodeswar, be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety of the like amount in the above crime, on the conditions that; (a) The applicant shall not tamper with the prosecution witnesses and shall attend the trial on each and every date.
