JUDGMENT : (PER : CHIEF JUSTICE) 1.

Rule. Rule is made returnable forthwith. By consent of the parties, the matter is heard finally.

The Petitioner was appointed on the post of Forest Labour on daily wage basis in the year 1982. According to the Petitioner, she is performing her duties till date and is entitled to regularisation. The grievance in the Petition is that the Deputy Director of Social Forest and Cultivation Officer of Social Forest, Jalna has prepared a proposal seeking regularisation of services of the Petitioner in view of the Government Resolution dated 16.10.2012. However, no action has been taken on the aforesaid proposal. Hence, this Petition.

The learned counsel for the Petitioner submits that a Writ of Mandamus be issued to the Respondent Nos. 4 and 5 Deputy Director of Social Forest, Jalna and Cultivation Officer of Social

- 3 - Forest, Jalna to forward the prepared proposal seeking regularisation of services of the Petitioner, to Respondent No. 3-Director of Social Forest, Pune.

The learned AGP, on instructions, submits that the Director of Social Forest, Pune shall take appropriate decision on the proposal of Deputy Director of Social Forest and Cultivation Officer of Social Forest, Jalna within a period of six weeks from today. 5.

In view of the aforesaid submission made by the learned counsel for the parties, the Petition is disposed off with a direction to the Director of Social Forest, Pune to consider and decide the proposal submitted by the Deputy Director of Social Forest and Cultivation Officer of Social Forest, Jalna, within a period of six weeks from today.

Needless to state that the Director of Social Forest, Pune shall decide the claim of the Petitioner in accordance with the policy of the State Government. It is clarified that this Court has not expressed any opinion with regard to the regularisation.
