Heard. The petitioner has been granted furlough with a rider that he shall furnish a surety bond. The fact is that, the petitioner is in Open Prison. The Full Bench of this Court in case of Dipak s/o Sudhakar Wakalekar Vs. State of Maharashtra & ors. [2011 ALLMR (Cri) 1933], observed :- "A convict confined in open prison can be released on parole by the authorities by dispensing with requirement of execution of bond by the relatives." 2.

In view of the above, we set aside the order dated

11/4/2023 and direct the authority concerned to release the petitioner on his P.R. bond in a reasonable amount. The Writ Petition is disposed of.
