Being aggrieved by the order dated 30.03.2017 passed by learned 5th Joint Civil Judge, Senior Division, at Ahmednagar below Exh.80 in Regular Civil Suit No. 258 of 2012, the petitioners-original defendant Nos. 3 to 7 have filed the present writ petition. 2.

After hearing learned counsel for the respective parties to some extent, learned counsel for the petitioners, on instructions, submits that this writ petition may be allowed subject to payment of costs of Rs.5000/- (Rupees five thousand only) to be paid by the petitioners to respondent Nos. 2 and 3 within a period of four weeks from today. Learned counsel for the respondents has no objection for the same.

In view of above, writ petition is allowed in terms of prayer

wp7952.17 -2clause "B" subject to payment of costs of Rs.5000/- (Rupees five thousand only) to be paid by the petitioners to respondent Nos. 2 and 3, within a period of four weeks from today.

Writ petition is accordingly disposed of.
