2025:BHC-AUG:22543-DB
IN THE HIGH COURT OF JUDICATURE AT BOMBAY
BENCH AT AURANGABAD WRIT PETITION NO. 8314 OF 2025 Madhukar Mansing More & Anr.
...Petitioners
Versus
The State of Maharashtra & Ors.
...Respondents
*** Mr. Aghav Avinash D., for Petitioners.
Mr. S. V. Hange, AGP for Respondents.
*** CORAM : MANISH PITALE AND Y. G. KHOBRAGADE, JJ.
DATE : 19th AUGUST 2025.
P. C. :
1.
On 30th July 2025, we have passed the following order : "1.
The grievance of the petitioners is that although as per policy reflected in Government circular dated 17.03.2017 and inclusion of names of the Petitioners in circular dated 30.03.2021 for award of certificates as ideal Gramsevaks, the awards ceremony was not organised for distribution of such certificates for the year 2019-2020. It is stated that such award distribution ceremonies for the years 2022-2023 onwards have been organised but prior to that, because of Covid-19 pandemic, the ceremonies were not organised.
2.
We are of the opinion that this Court exercising jurisdiction under Article 226 of the Constitution of
India cannot issue a Mandamus to organise such award distribution ceremony, but since circular dated 30.03.2021 indeed includes the names of the Petitioners in the list of awardees for ideal Gramsevaks for the year 2019-2020, such certificates must be sent to the Petitioners.
3.
For this limited purpose, the learned AGP representing all the Respondents seeks short accommodation to take instructions.
4.
Hence, list on 19.08.2025 in the same category." 2.
Today, learned AGP has taken specific instructions. In fact, copy of communication dated 06th August 2025, addressed by the Additional Commissioner (Establishment), Chhatrapati Sambhajinagar addressed to the Chief Executive Officers of the Zilla Parishad is tendered. The same is taken on record and marked "X" for identification. The said communication records that tomorrow i.e. on 20th August 2025, at 03:30 p.m. a program has been organized in the office of the Divisional Commissioner of Chhatrapati Sambhajinagar, wherein certificates pertaining to award of ideal Gramsevak are to be given to various individuals, including the petitioners. This shows that the certificates would indeed be handed over to the petitioners and other persons recorded in the said communication.
3.
We are of the opinion that the grievance of the petitioners is substantially satisfied in the light of the said communication. 4.
In that light, the writ petition is disposed of. Pending applications, if any, also stand disposed of. (Y. G. KHOBRAGADE, J.) (MANISH PITALE, J.)
