Heard Mr. Golegaonkar, learned counsel for the petitioners. He submits that the petitioners are not paid salary though orders placing these petitioners on supernumerary posts are set aside. 2.
Learned A.G.P. submits that as far as Petitioner No.1 is concerned, he is again placed on supernumerary post under order dated 16th October, 2020. As far as Petitioner Nos. 2 to 4 are concerned, their salary would be paid after following due procedure.

Petitioner No.1 will have to assail order dated 16th October, 2020 passed against him. In light of that we give liberty to Petitioner No.1 to assail 1 / 2
1007-WP-6740-20.odt the said order by way of separate petition and claim further relief. 4.
Petition is, as such, restricted to Petitioner Nos. 2 to 4. There is no impediment for the respondents to pay salary to Petitioner Nos. 2 to 4 regularly.

In light of above, the respondents shall pay salary to Petitioner Nos. 2 to 4 as admissible to them regularly till their validation proceedings are decided. The arrears shall be paid within a period of three months from today and salary shall be paid regularly. Depending upon the order of scrutiny committee, the respondents may take further steps. Writ petition is disposed of.
