IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD CIVIL REVISION APPLICATION NO. 133 OF 2019 Shailesh Eknath Gore ... Applicant

Versus

Sulochana w/o Anna Patil Sonawane ... Respondent ....

Mr. S. S. Randive, Advocate for applicant.

Mr. V. I. Thole, Advocate for respondent.

....

CORAM : R. G. AVACHAT, J.

DATED : 7th OCTOBER, 2019 PER COURT :- 1.

Mr. Thole, learned counsel informs to have instructions to appear on behalf of respondent. He informs that he will file his power in the office.

2.

Both the learned counsel are ready to work out the matter. 3.

Now, after hearing learned counsel for the applicant for some time, this Court made a proposal that whether the applicant would vacate the premises within a reasonable time. On instructions, the learned counsel seeks six months time to vacate the premises.

2 8-cra-133-19.doc 4.

Learned counsel for the respondent, on the other hand, gives three months time. According to him, the landlord and his wife are septuagenarian. The landlord has to travel about 8 kms. for attending his shop. The wife of landlord is a heart patient. In the circumstances, three month time would be reasonable for vacating the premises by the applicant-tenant.

5.

It is reported that the possession warrant has already been issued and handed over to the bailiff.

6.

In my considered view, six month time is a reasonable time, to be given to the applicant-tenant for vacating the premises. 7.

In this view of the matter, the civil revision application stands disposed of as per the statement given by the applicant that he would vacate the premises within a period of six months from today i.e. on or before 6th April, 2020. In the meanwhile, the applicant-tent shall pay the monthly rent to the landlord, until the premises are vacated. The applicant-tenant to furnish necessary undertaking in this regard before the executing Court within a period of one week from today. [ R. G. AVACHAT, J. ] SMS
