1] Heard learned counsel appearing for the parties. 2] The respondent no.4 - college, which is affiliated to the respondent no.3 - University, should proceed and release the markmemo, the result for all Semesters, namely, Second, Third and Fourth year of Bachelor of Mechanical Engineering degree course. All the original documents shall also be returned to the petitioner as he desires to study further. Merely because the claim has not been scrutinized by the competent scrutiny committee,
WP 8104/17 2 a party. like the petitioner, who has tendered his caste certificate, claimed admission against a reserved seat and who was already admitted, should not suffer. 3] In the light of the general directives of the Directorate of Technical Education, we dispose of this writ petition with a direction that within one week from today, all the original documents relating to the petitioner, as listed above, shall be handed over to him by the college. The petitioner's study upto the degree course and further, shall be subject to the outcome of the proceedings and final order of the scrutiny committee. No equities can be claimed by the petitioner in the event the certificate of validity is refused. 4] The writ petition is disposed of accordingly. No costs.
