PER COURT :- The petitioner claims appointment on compassionate grounds. The application of the petitioner is rejected on the ground that the petitioner has applied 9 years and six months of his becoming measure.

The learned counsel for the petitioner submits that mother of the petitioner had immediately applied, seeking appointment on compassionate grounds. However, respondents did not communicate the mother of the petitioner and subsequently, the petitioner had applied. Respondents are bound to consider the claim of the petitioner for appointment on compassionate grounds.

The father of the petitioner died in the year 1998 almost 21 years back. The policy giving appointment on compassionate

{2} wp 12592.18.odt grounds is to provide immediate succour to the family of the deceased dying in harness. After 21 years the said need cannot be said to survive. The petitioner applied for appointment on compassionate ground nine years and six months after becoming major.

In the light of above, the action of respondents cannot be faulted with.
