The present Petitioner has moved proceedings under Section 28-A of the Land Acquisition Act, 1894.

Shri Deshmukh, the learned advocate representing Cidco, submits that the enhanced award under Section 18 has been challenged in First Appeal (Stamp) No.4459/2024. By order dated 19.03.2024, passed in Civil Application No.2772/2024, the learned Single Judge Bench has stayed the award which enhanced the compensation.

The learned advocate for the Petitioner, therefore, submits that the Petitioner desires to withdraw this Petition and he would file a fresh Petition, if there is a fresh cause of action.

In view of the above statement, this Writ Petition is disposed off as withdrawn on instructions.
