Mr Bagul, learned Counsel for the petitioner makes a motion for withdrawal of the present petition with liberty to prefer an appeal before the School Tribunal under Section 9 of the Maharashtra Employees of Private Schools (Condition of Service) Regulation Act, 1977.

The motion since is not objected, as such stands granted. Writ Petition stands disposed of as withdrawn with liberty as prayed for. 3.

The time consumed in prosecuting the present writ petition before this Court be taken into account by the Tribunal while dealing with the issue of condonation of delay.
