The learned Assistant Government Pleader and the learned counsel for the respondent submits that as the petitioner has not yet submitted the legal heirship / succession certificate, the amount of compensation in the name of the deceased person is not paid to the petitioner. If the petitioner submits the legal heirship / succession certificate, the respondents would make the payment to the petitioner of the amount payable to deceased Kautik Mahale.

The petitioner may get the legal heirship / succession certificate from the Court and submit it to the respondents / authorities. The respondents / authorities shall upon the petitioner submitting the legal heirship / succession certificate may process the claim of the petitioner for the payment of the amount of compensation as was payable to Kautik Mahale and the same shall be paid to the petitioner accordingly. The respondents may keep the amount in fixed deposit, so that the amount would not remain idle and interest would be accrued on the same.

Writ Petition accordingly stands disposed of. No costs.
