Heard the learned counsel for the applicant, the learned A.P.P. for respondent No.1 and the learned counsel for respondent No.2/victim.

The applicant is seeking bail in C.R.No.64 of 2023 registered with Shillegaon Police Station, Taluka Gangapur, District Aurangabad, for the offences punishable under Sections 376(2)(n) (f)(j), 506 read with Section 34 of the Indian Penal Code and Sections 4, 5(j), (2)(l)(n), 6, 8 and 12 of the Protection of Children from Sexual Offences Act, 2012.

Considering the involvement of close relative of the victim as an accused and the statement of the witnesses including the victim as regards arraigning the applicant as accused in the crime,
932-BA-980-23.odt the Court feel it inappropriate to discuss the facts in detail, to protect the identity of the victim and her family. However, it appears that the role allegedly attributed to the applicant is doubtful. The material evidence is not against him. Hence, the order:- i) Bail application is allowed.
ii) Applicant Sandip @ Sanjay Ratan Shinde be released on bail, on furnishing PB and SB of Rs.50,000/-, with one solvent surety of the like amount, in C.R.No.64 of 2023 registered with Shillegaon Police Station, Taluka Gangapur, District Aurangabad, for the offences punishable under Sections 376(2)(n)(f)(j), 506 read with Section 34 of the Indian Penal Code and Sections 4, 5(j), (2)(l)(n), 6, 8 and 12 of the Protection of Children from Sexual Offences Act, 2012, on the conditions that, (a) He shall not tamper with the prosecution witnesses. (b) He shall not contact the victim or the other witnesses. (c) He shall not enter the village where the victim is residing till conclusion of the trial.
