By way of present petition, the petitioner challenges the memorandum of charge sheet dated 23.11.2020 on the grounds inter alia that the same has been issued after inordinate delay. 2.

Today Mr. Joshi, learned advocate appearing for the petitioner produces copy of representation dated 09.05.2022 submitted to the Disciplinary Authority in which the petitioner has pointed out that he has been acquitted in respect of the criminal proceedings. It is submission of Mr. Joshi that filing of criminal cases was essentially the reason that the petitioner came to be implicated in the disciplinary proceedings and now that he is acquitted in the criminal cases, natural consequence is

2 wp 8174.21 to drop the disciplinary proceedings.

Mr. Joshi, therefore seeks leave to withdraw present petition with liberty to make a detailed representation to the respondent disciplinary authority for dropping the charge sheet on the ground that he has been acquitted in all the criminal cases.

The writ petition is accordingly dismissed as withdrawn with liberty as prayed. In case such representation is made by the petitioner, same shall be decided by the respondent authority within a period of four (04) weeks from the date of receipt of the same, on its own merits and in accordance with law.
