The learned Counsel for the parties have, therefore, prayed for disposing of the present appeal in view of the consent terms.

The learned Counsel for the respondents pointed out that, for the reasons beyond the control of the respondent no.1, he could not withdraw the suit bearing no.972/2012 pending on the file of the Civil Judge, Junior Division, Nanded. The learned Counsel, on instructions, submitted that the suit will be withdrawn by the

The present appeal is disposed of in terms of compromise arrived at between the parties.
