DATE : 26.07.2021 PER COURT :- Daughter of the complainant eloped with Sagar Chimaji Aslam on 28.05.2021. Whereafter, the complainant reported the incident on 29th May, 2021. Applicant is a friend of Sagar - accused No.1. Remand report dated 4th June, 2021 conveys that the applicant and co-accused Chaitanya Ghosh had arranged for vehicle to facilitate Sagar to elope with the daughter of the complainant. It may be stated that at the material time, the daughter of the complainant was 17 years
11- A.B.A. No.771-2021.odt and two days old. Applicant herein is a college student, studying in 12th standard. Additionally, it is reported that the accused No.1 and 2, i.e. Sagar and Chaitnya Ghosh were arrested and released on bail. In consideration of the facts noted above, in my view, custodial interrogation of the applicant, shall not further the prosecution case. Hence, the order :-
ORDER
(i) In the event of arrest of the Applicant Rohit Vilas Bhingardive, in connection with Crime No. 201/2021 registered with Bhingar Camp Police Station, Ahmednagar for the ofences punishable under Sections 363, 376(2)(n), 366A, 109, 120-B read with Section 34 of the Indian Penal Code and under Section 4,8, 12, 17 of POCSO Act, he shall be released on bail on executing P.R. bond in the sum of Rs. 20,000/- (Rupees Twenty Thousand) with one or two sureties in the like amount.
(ii) The Applicant shall join the investigation as and when called by the Investigating Ofcer.
