Heard. The applicant being a member of unlawful assembly, in prosecution of common object held assault on Mohammad Abdul Muneeb Abdul Wahab and his son Mohammad Umer Abdul Muneeb by deadly weapon. Mohammad Abdul had suffered simple injuries over face below left eye, left leg and one grievous injury causing fracture of mid shaft tibia and fibula left side and Mohammad Umer had sustained simple injuries by hard and blunt object on face below left eye and left cheek.

The FIR prima facie discloses complicity of the applicant in the crime. Having regard to the gravity of the offence and nature of injuries caused to the injured, the application is rejected.

At this stage, after dictating the order, learned Counsel for the applicant, on instructions, seeks leave to withdraw the application.
