Heard learned Counsel on Civil Applications for withdrawal of amount.

Having regard to the grounds of objections raised in exception to the impugned Awards and the averments in the applications for withdrawal of the amount, the respective applicants are permitted to withdraw 50% of the deposited amount on submitting an undertaking that in the event any adverse order is passed against them, they will re-deposit the said amount within four months of passing such order. Balance 50% amount be invested in Fixed Deposit Receipt of any Nationalized Bank, initially for a period of two years and if so required for further period till disposal of the appeal. Civil Applications for withdrawal of amount stand disposed of in above terms.

Heard learned Counsel on Civil applications for condonation of delay.

In Civil Application No.4988/2016, office remark shows that respondent no.1A is reported to be dead. Learned A.G.P. pointed out that the legal heirs of deceased respondent no.1-A are already on record. Learned Counsel appearing for respondent
(3) nos. 2 to 5 concedes this position. Service is, therefore, held complete.

Learned Counsel appearing for original claimants though has opposed for condonation of delay, for the reasons stated in the applications which, according to me, are just and sufficient, and having regard to the fact that public money is involved, the delay caused in filing the appeals is condoned. Civil Applications for condonation of delay stand disposed of. The Appeals be registered in accordance with law. 5.
After registration of the appeals, issue notice to the respondents in the appeals returnable after four weeks. Shri Pokharkar, learned Counsel, waives service for original claimant. Service complete. Call for R & P.
