Respondent No.3 has passed away. By this civil application, the applicant/petitioner seeks condonation of delay of 337 days and prays for bringing the LR's of the deceased respondent No.3 on record. It is informed that the parties have settled the dispute between themselves.

Learned Advocate appearing on behalf of the respondents submits that he can appear on behalf of the LR's of the deceased respondent No.3.

In view of the above, the civil application is allowed and the khs/JUNE 2019/4592

- 2 - LR's of deceased respondent No.3 are permitted to be brought on record.

The learned Advocates for the respective sides jointly submit that the parties have settled the dispute. The terms of settlement dated 10/06/2019, which is filed in the Court today, are placed on record. The same (6 pages) are marked as Exhibit "X" for identification. They submit that this petition can be disposed off in terms of the settlement and the impugned award of the Labour Court would stand merged in the settlement terms.

Considering the above, this petition is disposed off in view of the settlement terms Exhibit "X". The directions of the Labour Court set out in the impugned award shall stand replaced by the terms of settlement between the parties. The settlement terms would constitute a part of this order and the litigating sides seek certified copies of this order, the terms of settlement Exhibit "X" shall be annexed to the said order.
