Mr. Jadhav, the learned counsel for the petitioner submits that, the father of the petitioner was working as a Senior Clerk with the Respondent No. 5 / School. While on duty, he died. The petitioner filed application seeking appointment on compassionate ground for the post of Junior Clerk as the petitioner possesses the necessary qualification of H. S. C. and MH-CIT. The learned counsel submits that, the Respondent No. 4 appointed the petitioner on compassionate ground on

2 WP6326.14 08.06.2009. Even proposal was submitted by the Respondent Nos. 4 and 5 for approval to the Education Officer. The said proposal was rejected on the ground that, because of the reduction in the strength of students, the post of Junior Clerk is not admissible. According to the learned counsel the post of Junior Clerk is vacant with the respondent institution, however, the respondents are not considering the case of the petitioner. 2.

The learned counsel for Respondent Nos. 4 and 5 on instructions submits that, at present there is no post of Junior Clerk vacant. As and when vacancy arises, the petitioner would be considered for appointment on compassionate ground and subject to the approval to be granted by the Education Officer, the petitioner would be appointed.

We accept the statement made by the learned counsel for Respondent Nos. 4 and 5. Accepting the said statement, the writ petition stands disposed of. No costs.
