The learned A.P.P. shown communication made by Jinsi Police Station, Aurangabad city. It shows that in C.R. No.456/2019, charge-sheet is filed on 12.10.2020. Learned A.P.P. submits that police formed opinion that simple injury is sustained.

Learned Counsel for the petitioner submits that fighter was used as weapon. If fighter was used as weapon and the Court treats it as a dangerous weapon, then the offence may become punishable under Section 324 of Indian Penal Code. That needs to be ascertained by the trial Court. As the chargesheet is filed according to the statement made by the learned A.P.P., there is no question of transferring of investigation. So, Criminal Writ Petition stands disposed of.
