Mr. Karlekar, learned A.G.P. submits that the proposal of the petitioner for validation of his tribe claim was forwarded to the Nashik Scrutiny Committee. However in the year 2001, the matters pertaining to the jurisdiction of Aurangabad were transferred to the Aurangabad Scrutiny Committee, but the matter of the petitioner cannot be traced out.

It appears that the proceedings are being forwarded by the employer with the Scrutiny

2 wp 7132.19 Committee at Nashik. Respondent no. 1 / Scheduled Tribe Certificate Scrutiny Committee, Aurangabad Division, Aurangabad shall endeavour to trace out the matter with the assistance of the Nashik Scrutiny Committee within a period of 15 days. If the file is not traced out within 15 days, then the parties shall co-operate in reconstructing the file and the file shall be reconstructed within a month of submitting copies of all the necessary documents. The committee shall thereafter decide it within a period of three (03) months. During this period, respondent no. 2 / Divisional Controller, Maharashtra State Road Transport Corporation, Aurangabad Division, Aurangabad if there is no other impediment, may forward the pension proposal and the proposal shall be processed.

The writ petition is accordingly disposed of. No costs.
