The record reveals that being aggrieved by order dated 09-04-2018, passed in Regular Civil Appeal No. 84/2017, by which learned District Judge-3, Aurangabad set aside the judgment and decree passed in Regular Civil Suit No.182/2014 by learned Joint Civil Judge, Junior Division, Paithan, District Aurangabad on 25-02-2017 and remanded the matter back to the trial Court for fresh decision in the light of directions given in the judgment. 3.

Shri Patni, learned advocate for appellant, submitted on record the order dated 02-11-2018 passed by the learned Civil Judge, Junior Division, Paithan which is marked as Exhibit 'X' for identifcation, and submitted that parties have settled the dispute by way of mediation.
