By the present application, the insurance-company prayed for condonation of delay of 35 days caused while lodging the appeal, challenging the judgment and award dated 19.01.2017 passed by the Member, Motor Accident Claims Tribunal, Dhule in M.A.C.P. No. 79 of 2015.

The grounds set out in the application and considering the submissions on behalf of non applicant, I am satisfied that the delay of 35 days is duly explained by the applicant. Therefore, I am inclined to grant the present application and proceed to pass the following order:-

O R D E R

(i) The civil application is allowed.

(ii) The delay of 35 days caused while lodging the appeal, is hereby condoned.

(iii) Office to register the first appeal and place before this Court on 21.03.2024 for further action.
