Pursuant to the order impugned dated 18.05.2012, during pendency of the petition, the Chief Executive Offfcer, Zilla Parishad, Osmanabad has passed an order dated 16.07.2015 whereby, while the suspension of the petitioner is revoked, the decision whether the period of suspension is to be treated as period of duty or otherwise, is deferred till the decision of the Court in which the criminal prosecution against the petitioner is pending.

Learned Counsel for the petitioner states that the petitioner is desirous of withdrawing the present petition with liberty to challenge the decision which may be taken by the
