Learned Counsel for contesting Respondent No. 2 has raised objection with regard to the maintainability of the Petition on the ground that alternate remedy is available against impugned order. 2.
Learned Counsel for the Petitioner, on instructions, seeks withdrawal of the Petition to file Revision under Section 154 of the Maharashtra Cooperative Societies Act, 1960. He, however, seeks exclusion of the period spent in the prosecution of the present Petition while computing period of limitation. 3.
Petition is dismissed as withdrawn with liberty as prayed. The period spent on prosecuting this Petition be excluded from computation of period of limitation for filing Revision.
